Welcome to Clinton English. These Terms of Service govern your enrolment and participation in English language courses at Clinton English Melbourne (CRICOS Provider 03895J). By enrolling in a course, you agree to be bound by these terms.

1. Enrolment and Fees

1.1 Enrolment is confirmed upon payment of the enrolment fee and receipt of a Confirmation of Enrolment (CoE) or enrolment confirmation letter.

1.2 Course fees are as published on our Course Fees page and are subject to change. All fees must be paid in Australian dollars (AUD).

1.3 A CoE deposit may be required for student visa applicants. This deposit is non-refundable after the CoE is issued.

1.4 Payment methods: bank transfer, credit card, or as otherwise communicated by Clinton English administration.

2. Refund Policy

2.1 Visa refusal: Full refund of tuition fees paid, less the enrolment fee, upon presentation of a refused visa notification from the Department of Home Affairs. Refund requests must be made within 28 days of the visa refusal.

2.2 Course cancellation by Clinton English: Full refund of all fees paid if Clinton English cancels a course before commencement.

2.3 Student withdrawal: Withdrawal more than 4 weeks before course start: full refund of tuition fees, less enrolment fee. Withdrawal within 4 weeks of course start: 50% refund of tuition fees. Withdrawal after course commencement: no refund.

2.4 Refunds are processed within 28 days of approval and paid to the original payment source.

3. Attendance Requirements

3.1 International students on a student visa must maintain a minimum of 80% attendance as required by the ESOS Act and National Code 2018.

3.2 Poor attendance may result in enrolment termination and reporting to the Department of Home Affairs via PRISMS.

3.3 Students on other visa types (including Working Holiday Visa) are expected to attend regularly but 80% attendance is not a visa condition for non-student visa holders.

4. Student Conduct

4.1 Students must comply with Australian laws, the ESOS Act, the National Code 2018, and Clinton English policies.

4.2 Misconduct including harassment, discrimination, fraud, or disruption of classes may result in warning, suspension, or expulsion without refund.

4.3 Clinton English reserves the right to refuse service or enrolment to any individual at its discretion.

5. Course Changes and Transfers

5.1 Course changes (e.g., General English to IELTS Preparation) may be permitted subject to placement assessment and availability. Course fees may be adjusted accordingly.

5.2 Transfers between Clinton English campuses (if applicable) are subject to availability and written approval.

6. Disclaimer and Liability

6.1 Clinton English makes every effort to ensure course information, timetables, and staff details are accurate but reserves the right to make changes where necessary.

6.2 Clinton English is not liable for loss or damage to personal property, or for circumstances beyond its control (force majeure, acts of God, government action).

6.3 Information provided by Clinton English staff regarding visa outcomes is advisory only. Visa decisions are made by the Department of Home Affairs, not Clinton English.

7. Intellectual Property

7.1 Course materials, handouts, and content produced by Clinton English teachers are for student use only and may not be reproduced commercially without written permission.

8. Privacy

8.1 Your personal information is collected and handled in accordance with our Privacy Policy and the Australian Privacy Act 1988 (Cth).

9. Governing Law

9.1 These terms are governed by the laws of Victoria, Australia. Any disputes shall be subject to the exclusive jurisdiction of the courts of Victoria.
